Which rules apply
Hospitals and health networks. In Ontario, PHIPA governs personal health information held by custodians such as hospitals. The custodian stays responsible when an agent, including a technology vendor, handles that information. Hospitals also fall under Ontario's cyber security regulation under the Enhancing Digital Security and Trust Act from July 1, 2026.
Clinics and practices. IPC Ontario's guidance on AI scribes, published January 28, 2026, covers vendor assessment, contract terms, human review of AI-generated notes and consent. In Alberta, custodians submit a privacy impact assessment to the Commissioner before introducing a new administrative practice or information system. In Quebec, the Act respecting health and social services information has applied since July 1, 2024.
Pharma, biotech and medtech. Health Canada's pre-market guidance for machine-learning-enabled medical devices, published April 1, 2026, covers Class II, III and IV devices and introduces predetermined change control plans. Internal AI for documents and research is governed by privacy law and company quality systems.
US data. HIPAA applies only when you handle records of US patients as, or for, a covered entity.

Can a clinic use an AI scribe under PHIPA?
Yes, with safeguards. IPC Ontario's January 2026 guidance on AI scribes covers vendor assessment, contract terms, human review of every note and consent; it says consent would generally be required because no statutory provision explicitly permits an AI scribe to collect personal health information without it.
Who is responsible when an AI vendor handles patient data?
The health information custodian. PHIPA makes the custodian responsible for personal health information in its custody or control, including when an agent such as a technology vendor handles it on the custodian's behalf. Contracts and access controls have to reflect that.
Can patient data be stored outside Canada?
It can be, with conditions. The IPC notes that PHIPA does not prevent storage outside Ontario or Canada, and the custodian remains responsible for protecting the information. Quebec's health information act requires a privacy impact assessment before information is communicated outside Quebec. We document where each vendor stores and processes data.
Is an AI tool a medical device?
It can be, if it uses machine learning to achieve a medical purpose. Health Canada's pre-market guidance for machine-learning-enabled medical devices applies to manufacturers of Class II, III and IV devices. Administrative tools such as scheduling or document drafting are a different category; we flag the boundary early.
Does HIPAA apply to Canadian health organizations?
HIPAA is US law and matters only when you handle records of US patients for a covered entity or as its business associate. Canadian organizations work under PHIPA, provincial health information acts and PIPEDA.
