Where AI helps financial teams

Which rules apply

Banks and credit unions. OSFI Guideline E-23 on model risk applies to all federally regulated financial institutions from May 1, 2027, and its model definition includes AI and machine learning methods. OSFI B-10 keeps the institution accountable for outsourced services and sets cloud-specific requirements, so an AI vendor goes through the same third-party review. For credit unions regulated in Ontario, FSRA's IT risk management guidance has applied since April 1, 2024. All are FINTRAC reporting entities with a compliance program and a compliance officer.

Insurers. E-23 applies to federally regulated insurers and covers actuarial models as well as AI. In Quebec, the AMF Guideline for the Use of AI takes effect on May 1, 2027 for authorized insurers, financial services cooperatives, trust companies and deposit institutions. Life insurance companies, brokers and agents are FINTRAC reporting entities.

Fintechs and payment companies. Money services businesses register with FINTRAC before they operate. Under the Retail Payment Activities Act, payment service providers register with the Bank of Canada, and the risk management and safeguarding requirements have applied since September 8, 2025.

Frequently asked questions

Does OSFI E-23 apply to generative AI?

Yes, when the tool meets E-23's definition of a model, which explicitly includes AI and machine learning methods. The guideline was published on September 11, 2025, takes effect on May 1, 2027 and expects a model inventory, a risk rating per model, independent review and monitoring.

Are credit unions covered by OSFI?

E-23 applies to federally regulated financial institutions. A provincially regulated credit union follows provincial rules instead: in Ontario, FSRA's IT risk management guidance, in force since April 1, 2024; in Quebec, the AMF Guideline for the Use of AI, which applies to financial services cooperatives from May 1, 2027.

Can AI file suspicious transaction reports with FINTRAC?

AI can prepare the case: gather transactions, draft the narrative and flag missing facts. The reporting entity's people decide whether reasonable grounds to suspect exist and submit the report as soon as practicable, as FINTRAC requires.

What does Quebec's Law 25 mean for automated credit or claims decisions?

Section 12.1 requires a business that makes a decision based exclusively on automated processing of personal information to inform the person and, on request, explain the main factors and allow review by a staff member. Keeping a person in the decision avoids that trigger and is often the better design anyway.

How much does AI consulting cost for a financial institution?
